These Terms of Use (“Terms”) govern your access to and use of www.thebodyshop.lk (the “Website”).
The Website is operated by Quest Holdings Lanka (Private) Limited (“Quest”, “we”, “us”, “our”). We are the exclusive authorized distributor and licensee of The Body Shop International Limited (“TBSIL”) in Sri Lanka. All products sold on this Website are sold by Quest (not TBSIL). All The Body Shop names, logos, and related intellectual property are owned by TBSIL and used by Quest under license.
If you do not agree to these Terms, please stop using the Website.

2) Acceptance, Eligibility & Accounts
2.1 Acceptance
By browsing, creating an account, or placing an order, you agree to these Terms and our Policies.
2.2 Eligibility
The Website is intended for individuals 18 years or older. If you are under 18, a parent or guardian must supervise and place orders on your behalf.
2.3 Account Security
You are responsible for safeguarding your login credentials and all activity under your account. Notify us immediately of any suspected unauthorized access. We may suspend or terminate accounts for suspected breach, fraud, or misuse.
3) Services Offered
The Website enables you to browse information, view and purchase The Body Shop products, and access related online services (collectively, the “Services”).
4) Using the Website (Availability, Technical & Safety)
4.1 We aim to keep the Website available but do not guarantee continuous, uninterrupted, or error‑free access. We may suspend, withdraw, or modify the Website (or any part of it) without notice.
4.2 You are responsible for ensuring your device, browser, software, and internet connection are compatible with the Website.
4.3 We do not warrant the Website is free of viruses or harmful code. Please use up‑to‑date security software.
5) Acceptable Use & Prohibited Conduct
You agree NOT to:
- copy, reproduce, modify, create derivative works of, or distribute Website content except as expressly permitted;
- reverse engineer, decompile, disassemble, or attempt to access the source code;
- use the Website unlawfully or to infringe intellectual property, privacy, or other rights;
- upload or transmit viruses, malware, harmful scripts, or automated attacks;

- abuse payment methods (including Cash on Delivery) or manipulate orders, prices, or promotions;
- Use the Website if you are subject to applicable sanctions prohibiting such use.

You must not conduct or facilitate:

- any use of Website data for training, fine‑tuning, or validating AI systems or models,
To the fullest extent permitted under Sri Lankan law.

6.2 Exactness Not Guaranteed: Colours, textures, packaging, weights, and product appearance may vary due to device differences, manufacturing changes, or supply constraints.
6.3 Cosmetic Safety & Allergies
Our products may contain ingredients that trigger reactions in some individuals.
Please:

- follow usage instructions,
- Perform patch tests where appropriate.
Discontinue use and seek medical advice if irritation occurs.

7) Intellectual Property
7.1 Website content—text, images, graphics, code, layout—is owned by or licensed to Quest and/or TBSIL.
7.2 THE BODY SHOP trademarks belong exclusively to TBSIL and are used under license.
7.3 You may view and print Website pages for personal, non‑commercial use only.
Any other use requires prior written permission.
7.4 We may terminate access and require destruction of materials obtained in breach of these Terms.
8) User‑Generated Content (UGC)
(Reviews, Q&A, Photos, Comments)
8.1 Your Warranties:
By submitting UGC, you confirm that:
- you are 18+;
- it is your original content;
- it is truthful, lawful, and non‑infringing;
- You will disclose if you received compensation or incentive.
8.2 License to Quest:
You grant us a worldwide, royalty‑free, transferable license to use, reproduce, modify, publish, and display your UGC for Website and marketing purposes (including social media).
8.3 Do NOT submit UGC that is:
false, misleading, defamatory, obscene, discriminatory, unlawful, harmful, spam, or containing malware.
8.4 We may moderate, edit, or remove UGC at any time.
9) Prices, Currency & Mispricing
9.1 Prices are shown in Sri Lankan Rupees (LKR) and may include or exclude taxes as stated at checkout. Prices may change at any time.
9.2 Mispricing Policy:
- If the correct price is lower, you will be charged the lower price.
- If the correct price is higher, we may seek your confirmation or cancel the order and issue a refund.
10) Promotions, Vouchers, Loyalty, Gifts & Samples
10.1 Promotions, discount codes, loyalty rewards, and gift vouchers may have specific terms, exclusions, and validity periods. Only one voucher/code applies per order unless stated otherwise.
10.2 We may amend or withdraw promotions. Abuse or misuse may result in cancellation or account suspension.
10.3 Gifts With Purchase (GWP) / Product With Purchase (PWP):
These may have shorter shelf lives. You may remove them at checkout.
10.4 Samples:
Samples displayed are for promotional purposes only and not for sale. Orders with excessive samples may be cancelled.
10.5 Sales/End‑of‑Season Offers:
Discounts apply only to selected items while stocks last. Offers have no cash value and are non‑transferable.
11) Orders, Acceptance, Fraud & Bulk Orders
11.1 Order Formation:
Your order is an offer to buy. Acceptance occurs only when we confirm dispatch.
We may decline or cancel orders prior to acceptance.
11.2 Fraud Detection:
We may cancel orders if we suspect:
- fraudulent activity,
- voucher misuse,
- pricing errors,
- Irregular patterns.
11.3 Bulk Orders / Resale:
We may cancel orders intended for resale, including multiple units of the same product or suspicious address patterns.
11.4 Cash on Delivery (if offered):
We may restrict COD for users involved in returns‑abuse or refusal‑to‑accept trends.
12) Payment & Unauthorized Charges
12.1 Accepted methods include cards, bank transfers, digital wallets, BNPL, and COD where applicable.
You confirm you are authorized to use the selected method.
12.2 For unauthorized charges, first check with family/colleagues. If still unrecognized, contact Customer Care within 60 days.
13) Shipping, Delivery, Title & Risk; Packaging
13.1 Delivery is available within Sri Lanka via designated courier partners. Fees and timelines appear at checkout.
13.2 Title and risk transfer upon delivery to your specified address or authorized recipient.
13.3 Inspect deliveries upon receipt and report issues within [Insert Days].
13.4 To reduce environmental impact, some items may ship without inner seals or additional packaging. Settling or shifts in product containers may occur during transit.

- Returns allowed within 15 Days for eligible items in original condition.
- For defective/damaged items, contact us within 15 Days for replacement/refund.
- Refunds will match the original payment method where possible.
Consumer rights under Sri Lankan law are unaffected.

We are not responsible for third‑party sites or tools linked from the Website. Access them at your own risk and review their policies.
16) Disclaimers & Limitation of Liability
16.1 The Website is provided “as is” and “as available”, without any warranties.
16.2 To the fullest extent permitted by Sri Lankan law, we are not liable for:
- indirect, incidental, special, punitive, or consequential losses;

- delays, viruses, system failures;

16.3 Allergies:
We are not liable for allergic reactions unless required by law.

- The amount paid for the product giving rise to the claim.

You agree to indemnify and hold Quest, its officers, employees, and agents harmless from claims arising from your breach of these Terms or misuse of the Website.
18) Privacy & Cookies
Your personal data is handled per our Privacy Policy and Cookies Notice, which outline what we collect, how we use it, and your rights under Sri Lankan law.
19) Suspension & Termination
We may suspend or terminate access or accounts for breach, fraud, or misuse. You may close your account anytime. Certain sections survive termination (IP, UGC license, disclaimers, indemnity, and jurisdiction).

These Terms are governed by the laws of Sri Lanka, and all disputes fall under the exclusive jurisdiction of the Courts of Colombo, subject to mandatory consumer laws.
23) Miscellaneous
- Entire Agreement: These Terms and our Policies are the full agreement regarding Website use.
- Severability: Invalid provisions do not affect the remaining Terms.
- No Waiver: Failure to enforce rights is not a waiver.
- Headings: For convenience only.
- Interpretation: Singular includes plural; “including” means without limitation.
